More than a year and a half after being charged, a Farrell man on Wednesday was found by a jury not guilty of possession with intent to deliver crack.
Antonio Smith, 20, of 1227 Washington St., was acquitted before Common Pleas Judge John C. Reed. He had been charged with possession of over 57 grams, about 2 ounces, of crack.
“He was pleased with the result,” said defense attorney Tedd Nesbit. In October 2006, police were at a Farrell convenience store for an unrelated reason.
They came around the side of a car that Smith was a passenger in and saw the drugs, Nesbit said. “And so it was just a question of whose drugs they were, basically.”
While the other defendant testified against him, Smith had said from the start they weren’t his drugs, Nesbit said.
The trial lasted two days and the jury came back with a “not guilty” verdict at about 7:30 p.m. Wednesday, he said.
