- — Man arrested after turf battle over Nerf dart gun

FARRELL – A Masury man has been charged with simple assault for punching a man during a skirmish over a Nerf dart gun.

Zachary M. Tarpenning, 23, of 494 Stateline Road, was hanging out at 6:16 p.m. Dec. 31 at a home in the 1300 block of Farrell Terrace, Farrell, and was shooting a man with the dart gun, Southwest Mercer County Regional police said.

The man repeatedly told Tarpenning to stop, but Tarpenning kept firing, police said.

The man went to take the toy away from Tarpenning and they fell to the ground, police said. Tarpenning punched the man in the head several times, police said.

Tarpenning was arraigned and faces a preliminary hearing at 9 a.m. Jan. 19 in district court in Farrell. He was released after posting bond.

Farrell man convicted of assault in Clarion County

FARRELL – A Farrell man was convicted in December of aggravated assault and other charges for the Feb. 2 shooting of a 19-year-old woman in Clarion County.

Kevin L. “Deuce” Austin II, 21, of 222 Shenango Blvd. was found guilty at trial of two counts of aggravated assault, one count each of simple assault and prohibited possession of a firearm and four counts of reckless endangerment.

He was found not guilty of attempted homicide and nine other counts, but one of the aggravated assault charges is a first-degree felony, the same degree as attempted homicide, punishable by up to 10 to 20 years in prison.

Sentencing was set for Jan. 22.

According to media reports, prosecutors showed that a fight broke out at an outdoor party at an apartment complex and someone showed a gun. The party broke up and a car drove by, from which Austin fired several shots and a Clarion University student was hit in the leg.

Austin is held in jail on $500,000 bond.
