Murder suspect gets time served for jailhouse assault

MERCER COUNTY — One of the men accused in the William “Bill” Basilone Jr. homicide was sentenced Friday for his part in an attack on another inmate at Mercer County Jail.

Devine Campbell was sentenced to 3 to 18 months for simple assault and given 6 months probation for theft.

Mercer County Common Pleas Court President Judge Thomas R. Dobson gave Campbell credit for 241 days that he has been held awaiting trial in the Basilone case but ordered the probation  period to begin after the assault sentence.

Campbell, 18, was one of several men who went into another inmate’s cell June 1 of last year to steal some of his possessions. Cambell punched him in the face, splitting his lip.

“Mr. Campbell knows what he did was wrong,” victim Brian McNamee told Dobson. “Whatever consequences the court hands down, I am sure will be more than fitting.”

McNamee, who has completed his sentence, acknowledged having committed crimes himself and said the beating and the 19 stitches he got “helped me affirm just why I don’t want to find myself back there again.”

Campbell had no comment during the hearing.

Separate trials are scheduled in July for both Campbell and Joshua L. Stewart, 19, who also is held at Mercer County Jail.

Stewart is charged with first- and second-degree murder and is the alleged gunman who authorities say shot the 58-year-old Basilone at least five times Dec. 30, 2011, outside his Farrell bar. Prosecutors say Campbell was with Stewart at the time and conspired with him to commit the crime.

Both men also face two counts each of robbery and conspiracy in the case.
