Man attacked, robbed outside mall, police say

HERMITAGE — A man in his 20s was beaten and robbed Monday in a parking lot at the Shenango Valley Mall around 11 a.m. before he and others chased his suspected assailants down.

Dylan James Kubyako, 19, of 421 Stambaugh Ave., Sharon, and his juvenile brother struck up a conversation with the alleged victim  around 11 a.m. in the shoe department of JCPenney inside the mall when they saw him with a small wad of money, police said.

According to police:

They lured him out of the store into a parking lot outside the store on the north side of the mall by offering him free “blow” – slang for cocaine.

Once outside, Dylan started choking the man, and his brother tried to take his money. The pair punched the man multiple times and took $199 from him.

They knocked the man down, and an employee of the mall ran over to help and called Mercer County 911, as did several other people who saw the beating.

The victim chased the brothers into JCPenney, through the store, out of the main entrance to the mall and into the front parking lot where their car was parked.

Police said they caught up to the pair in the midst of a crowd that had formed in the parking lot near the Kubyako car.

Dylan and his brother first told police that the man was trying to steal their money and they had to use force to get it back from him, police said.

A witness confirmed the victim’s version of events, as did the two brothers later in their written confessions, police said.

The victim had cuts and bruises on his head, face and chest, police said.

Dylan Kubyako was charged with robbery, simple assault, theft by unlawful taking and three counts of criminal conspiracy for his part in the incident.

He was taken to Mercer County jail after failing to post the $20,000 bond imposed by District Judge Ronald E. Antos.

His younger brother was placed in juvenile detention until his court proceedings, police said.
